Privacy Policy or Information pursuant to Articles 13 and 14 GDPR
This statement describes how ACO-Advice Steuerberatung GmbH processes personal data and is directed at current and former clients, interested parties, potential future clients, as well as their respective shareholders, governing bodies, employees, suppliers, and contractors.
1. Purposes of Data Processing
We process your personal data for the following purposes:
− To establish, manage, and process the business relationship,
− To strengthen the existing client relationship or to establish a new client relationship, or to approach potential clients, including informing them about current legal developments and our range of services (marketing),
− In the event of an existing engagement, to manage the internal administration and damage management of the firm.
If an engagement has been made by the client:
− To carry out payroll accounting for clients (including monthly payroll, monthly and annual reporting to authorities, etc.),
− To carry out accounting for clients,
− To provide advisory and representation services in the area of tax law, levy law, and economic matters,
− To provide advisory and representation services in social security matters,
− To represent clients before administrative courts and authorities, and before legally recognized churches and religious communities in contribution matters, and before all other authorities,
− To provide other advisory services, to undertake trust tasks, and to manage assets within the scope of § 2 WTBG 2017,
− To independently perform those fiduciary economic tasks that require an assurance service by an independent auditor,
− To independently conduct other audits and agreed-upon investigations,
− To perform cost accounting (calculation), including advisory services in these areas,
− To provide advice and assistance in the area of accounting and financial reporting, and to close business books,
− To provide all consulting services and activities in connection with business accounting,
− To provide advice on the establishment and organization of an internal control system,
− To provide advice on labor law issues, as well as to carry out any other task assigned under § 2 WTBG 2017.
2. Legal Basis for Processing
For interested parties or potential future clients, we process contact data for direct marketing purposes, such as sending electronic mail (email) or contacting them by phone, only with your consent in accordance with Article 6(1)(a) of the General Data Protection Regulation (“GDPR”).
For existing clients, we process personal data because it is necessary to fulfill the contract concluded with them (Article 6(1)(b) GDPR).

3. Transfer of Personal Data

− Administrative authorities, courts, and public bodies,
− Economic trustees for auditing purposes,
− Insurance companies in connection with the conclusion of an insurance contract for the provision of services or in the event of an insurance claim (e.g., liability insurance),
− Clients, insofar as the data pertains to shareholders, governing bodies, and other employees of the respective client,
− Cooperation partners and legal representatives acting on our behalf,
− Other recipients designated by the client (e.g., group companies of the client),
− Additionally, in the case of personal data of employees of our clients in the field of payroll accounting: creditors of the employee and other parties involved in any associated legal proceedings, including voluntary salary assignments for outstanding claims, bodies of occupational and legal representation of interests, insurance institutions within the framework of existing group or individual insurance policies, and employee pension funds (MVK), banks involved in payments to the employee or third parties, company doctors, and pension funds, co-insured persons,
− Additionally, in the area of accounting: collection agencies for debt recovery, banks on behalf of the client, factoring companies, assignees, and leasing companies.
4. Retention Period
We generally retain personal data until the termination of the business relationship in connection with which we collected the data or until the expiration of applicable legal limitation and retention periods; further, until the conclusion of any legal disputes in which the data is required as evidence.
For existing clients, former clients, interested parties, potential future clients, or contact persons of any of the aforementioned, we retain personal data for marketing purposes until an objection is raised or consent is revoked, provided the marketing measure is based on consent.
5. Your Rights in Relation to Personal Data
You are entitled to:
− Check whether and which personal data we process about you and obtain copies of this data,
− Request the correction, supplementation, or deletion of your personal data, provided that it is incorrect or not processed in accordance with legal requirements,
− Request that we restrict the processing of your personal data,
− Under certain circumstances, object to the processing of your personal data or withdraw previously given consent for processing, whereby a withdrawal does not affect the legality of processing carried out before the withdrawal,
− Request data portability, insofar as you are our client,
− Know the identity of third parties to whom your personal data is transferred, and
− File a complaint with the data protection authority. 6. Integration of Third-Party Services and Content It may happen that content or services from third-party providers, such as city maps or fonts from other websites, are integrated into our online offering. The integration of third-party content always requires that the third-party providers perceive the IP address of the users, as they cannot send the content to the users’ browser without the IP address. The IP address is thus necessary for the display of this content. Furthermore, the providers of the third-party content may set their own cookies and process user data for their own purposes. Usage profiles of users may be created from the processed data. We will use these contents as sparingly and data-minimizing as possible and choose reliable third-party providers with regard to data security.
